Article 976
Au temps fixé pour l’audience, le greffier appelle la cause, constate la présence ou l’absence des parties et le juge rend le jugement suivant la preuve offerte.
Un juge peut, en tout temps avant l’audience sur le fond, entendre une demande préliminaire et rendre toute ordonnance utile.

Article 976
At the time fixed for the hearing, the clerk calls the case and ascertains whether the parties are present and the judge presiding judges the case according to the evidence presented.
At any time before the hearing on the merits, a judge may hear any preliminary application and issue any order as appropriate.
