Article 863.2
Lors de l’audition, le juge ou le greffier peut, suivant la nature de la demande, autoriser les personnes qui sont présentes et qui y ont intérêt, à faire des observations ou des représentations susceptibles de l’éclairer dans sa décision.
Cependant, s’il constate que les observations ou les représentations faites par une partie constituent une contestation réelle du bien-fondé de la demande, il ordonne le renvoi du dossier devant le tribunal, aux conditions qu’il détermine.

Article 863.2
At the hearing, the judge or the clerk may, depending on the nature of the application, authorize the persons who are present and have an interest in the application to make observations or representations that may afford information useful for making his decision.
However, if the judge or clerk ascertains that the observations or representations made by a party constitute actual contestation of the merits of the application, he orders that the record be referred to the court on the conditions he determines.
