Article 814.10
Une partie qui a des motifs sérieux de ne pas participer à la séance d’information sur la médiation peut déclarer ce fait à un médiateur de son choix; ces motifs peuvent être liés, entre autres, au déséquilibre des forces en présence, à la capacité ou à l’état physique ou psychique de la partie ou, encore, à la distance importante qui sépare sa résidence de celle de l’autre partie.
Le médiateur dresse alors un rapport portant déclaration expresse de la partie concernée qu’elle ne peut, pour des motifs sérieux qui n’ont pas à être divulgués, participer à la séance d’information; il produit ensuite son rapport au Service de médiation familiale et en transmet copie à la partie déclarante, ainsi qu’à l’autre partie si la demande a été déposée au greffe du tribunal.

Article 814.10
A party that has a valid reason not to attend the information session on the mediation process may state that fact to the mediator of his choice; the reason may relate, in particular, to the inequality of the power relationship, to the disability or the physical or psychological condition of the party or to the great distance between the party’s residence and that of the other party.
In such a case, the mediator draws up a report containing an express statement of the party concerned that the party cannot attend the information session for a valid reason, which need not be disclosed; the mediator then files his report with the Family Mediation Service and sends a copy to the party having made the statement and, if the application has been filed at the office of the court, to the other party.
