Article 169
Lorsque le jugement qui accueille une requête sur un des moyens prévus à l’article 168 enjoint au demandeur de faire un acte dans un délai imparti et que celui-ci fait défaut de s’y conformer, le défendeur peut, dès l’expiration du délai, obtenir le rejet de la demande ou la radiation des allégations concernées.

Article 169
When the judgment granting a motion based upon one of the grounds set forth in article 168 orders the plaintiff to do something within the time fixed and the plaintiff fails to do so, the defendant may, as soon as the time has expired, obtain the dismissal of the demand or the striking out of the allegations involved.
