Article 264
Le désistement remet les choses dans l’état où elles auraient été si la demande à laquelle il se rapporte n’avait pas été faite.
Il comporte obligation de payer les frais occasionnés par la demande, qui sont adjugés à la partie adverse, par le greffier, sur inscription.

Article 264
Discontinuance replaces matters in the state in which they would have been had the suit to which it applies not been commenced.
It involves the obligation to pay the costs occasioned by the suit, which costs are adjudged to the opposite party by the clerk, upon inscription.
