Article 263
Le désistement se fait par simple déclaration signée de la partie elle-même ou de son procureur, et présentée à l’audience ou produite au greffe.
Sauf s’il est fait à l’audience en présence de la partie adverse, le désistement ne devient opposable à celle-ci que s’il lui a été signifié.

Article 263
Discontinuance is effected by a simple declaration signed by the party or his attorney, and presented at the trial or filed in the office of the court.
Unless made at the trial in the presence of the opposite party, the discontinuance has no effect against him until it has been served upon him.
