Cet article reprend la règle énoncée à la première partie de l'article 1935 C.C.B.C., la seconde partie étant reprise à l'article 2343.


L'article n'exige pas que le cautionnement soit écrit; il pourrait donc être verbal. En ce cas, cependant, la preuve devrait être faite de l'intention ferme de la caution de s'engager ainsi.
