La remise du bien est essentielle pour que le contrat de dépôt soit parfait.
La remise feinte suffit quand le dépositaire détient déjà le bien à un autre titre.

Article 2281
Handing over of the property to be deposited is essential to perfect the contract of deposit.
Fictitious handing over is sufficient where the depositary already has detention of the property under another title.

Conformément au droit antérieur prévu à l'article 1797 C.C.B.C., cet article fait de la remise du bien un élément essentiel à la formation du contrat de dépôt, tout en prenant en compte la possibilité que le dépositaire détienne déjà le bien à un autre titre.
