Article 36
Le propriétaire d’un terrain situé dans la zone agricole de la municipalité locale au sens du paragraphe 17° de l’article 1 de la Loi sur la protection du territoire et des activités agricoles (chapitre P-41.1), celui d’un terrain situé hors de cette zone et qui y exerce une activité agricole au sens du paragraphe 0.1° de l’article 1 de cette loi, ou celui d’un terrain qui y exerce des activités forestières peut, à l’égard de ce terrain, demander par écrit à la personne désignée d’examiner toute question et de tenter de régler toute mésentente relative:1° à la construction, la réparation ou l’entretien d’une clôture mitoyenne ou d’un fossé mitoyen en vertu de l’article 1002 du Code civil; 2° à des travaux de drainage de ce terrain qui engendrent la création, l’aménagement ou l’entretien d’un fossé de drainage, soit celui:a) utilisé aux seules fins de drainage et d’irrigation; b) qui n’existe qu’en raison d’une intervention humaine; c) dont la superficie du bassin versant est inférieure à 100 hectares; 3° au découvert en vertu de l’article 986 du Code civil. La demande décrit la nature, l’étendue et le coût anticipé des travaux projetés, ainsi que la part estimée des propriétaires intéressés. Le propriétaire d’un terrain contigu à un terrain visé par le premier alinéa peut exercer, à l’égard de ce dernier, les droits prévus à cet alinéa, même s’il ne répond pas aux critères qui y sont énoncés. La personne désignée ne perd pas compétence du seul fait:1° qu’il existe un écart maximal de 10% dans l’évaluation de la surface drainée, ou 2° que la demande vise aussi un terrain situé sur le territoire d’une autre municipalité locale.

Section 36
The owner of land situated in the agricultural zone of a local municipality within the meaning of subparagraph 17 of the first paragraph of section 1 of the Act respecting the preservation of agricultural land and agricultural activities (chapter P-41.1), the owner of land situated outside that zone and who carries on an agricultural activity within the meaning of subparagraph 0.1 of the first paragraph of section 1 of that Act on that land, or the owner of land who carries on forest activities on that land may, regarding that land, request the designated person in writing to examine a matter and try to resolve a disagreement relating to1° the construction, repair or maintenance of a common fence or common ditch under article 1002 of the Civil Code; 2° drainage work on that land involving the creation, improvement or maintenance of a drainage ditcha) used solely for drainage or irrigation; b) that was artificially created; or c) the watershed of which has an area of less than 100 hectares; or 3° clearances under article 986 of the Civil Code. The application must describe the nature, extent and expected cost of the proposed work and provide an estimate of the contribution the interested owners must make. The owner of land adjacent to land referred to in the first paragraph may exercise the rights set out in that paragraph regarding that land, even if the owner does not meet the criteria specified in the paragraph. The designated person does not lose his or her mandate simply because1° there is a maximum discrepancy of 10% in the evaluation of the drained area; or 2° the application also concerns land situated in the territory of another local municipality.
