Article 107
Le propriétaire ou l’occupant d’un terrain doit permettre aux employés ou représentants de la municipalité régionale de comté l’accès au cours d’eau pour les inspections nécessaires à l’exercice de leurs fonctions. Il doit également permettre l’accès de la machinerie et des équipements requis afin de réaliser des travaux. Avant d’effectuer des travaux, une municipalité régionale de comté doit notifier au propriétaire ou à l’occupant son intention de circuler sur son terrain au moyen d’un préavis d’au moins 48 heures, à moins que l’urgence de remédier à la situation ne l’en empêche. La municipalité régionale de comté est tenue à la remise en état des lieux et, le cas échéant, à la réparation du préjudice causé par son intervention. À défaut d’entente, le montant de l’indemnité pour la réparation du préjudice causé est fixé par le Tribunal administratif du Québec à la demande de la personne qui le réclame ou de la municipalité et les articles 7 et 11, le troisième alinéa de l’article 12 et les articles 75 à 121 et 128 à 132 de la Loi concernant l’expropriation (chapitre E-25) s’appliquent, compte tenu des adaptations nécessaires.

Section 107
The owner or occupant of land must allow the employees or representatives of the regional county municipality access to the watercourse for the inspections necessary in the performance of their duties. The owner or occupant must also allow machinery and equipment any access required to carry out work. Before undertaking work, a regional county municipality must give the owner or occupant of the land at least 48 hours’ prior notice of its intention to move about on that land, unless prevented from doing so by the urgent need to remedy the situation. The regional county municipality is bound to restore the premises to their original state and to pay compensation for any damage caused by its intervention. Failing agreement, the amount of the indemnity for damage caused is fixed by the Administrative Tribunal of Québec at the request of the person claiming it or the municipality, and sections 7 and 11, the third paragraph of section 12, and sections 75 to 121 and 128 to 132 of the Act respecting expropriation (chapter E-25) apply, with the necessary modifications
