Article 434.6
Le propriétaire du véhicule routier saisi peut être remis en possession du véhicule, sur autorisation d’un juge de la Cour du Québec exerçant en son bureau en matière civile:
1° s’il n’était pas l’un des contrevenants et s’il ne pouvait raisonnablement prévoir qu’une personne contreviendrait à l’article 433 ou 434;
2° s’il était l’un des contrevenants autres que le conducteur et s’il établit qu’il n’était pas dans une situation interdite par l’article 433 ou 434;
3° s’il était le conducteur du véhicule et s’il n’avait pas toléré qu’une personne contrevienne à l’article 433 ou 434.
La Société lève la suspension du permis ou du droit d’en obtenir un imposée en vertu de l’article 434.2 si la personne concernée obtient la mainlevée de la saisie en vertu du premier alinéa.
Le deuxième alinéa de l’article 209.11 et les articles 209.11.1, 209.12, 209.13 et 209.15 s’appliquent avec les adaptations nécessaires.

Section 434.6
The owner of the road vehicle seized may, on the authorization of a judge of the Court of Québec acting in chambers in civil matters, recover his vehicle
1° if he was not one of the offenders and could not reasonably have foreseen that a person would contravene section 433 or 434;
2° if he was one of the offenders, other than the driver, and establishes that he did not contravene section 433 or 434; or
3° if he was the driver of the vehicle and did not tolerate the contravention of section 433 or 434.
If the person obtains the release of the seizure under the first paragraph, the Société lifts the suspension of the licence or of the right to obtain a licence imposed under section 434.2.
The second paragraph of section 209.11 and sections 209.11.1, 209.12, 209.13 and 209.15 apply, with the necessary modifications.
