Article 434.3
La personne, autre que le conducteur, dont le permis ou le droit d’en obtenir un est suspendu conformément à l’article 434.2 peut obtenir la levée de cette suspension d’un juge de la Cour du Québec exerçant en son bureau en matière civile après avoir établi qu’elle n’était pas dans une situation interdite par l’article 433 ou 434.
Le conducteur d’un véhicule routier dont le permis ou le droit d’en obtenir un est suspendu, conformément à l’article 434.2, peut obtenir la levée de cette suspension d’un juge de la Cour du Québec exerçant en son bureau en matière civile, après avoir établi qu’il n’avait pas toléré qu’une personne contrevienne à l’article 433 ou 434.

Section 434.3
A person, other than the driver, whose licence or right to obtain a licence is suspended under section 434.2 may obtain the lifting of the suspension by a judge of the Court of Québec acting in chambers in civil matters after proving that he did not contravene section 433 or 434.
The driver of a road vehicle whose licence or right to obtain a licence is suspended under section 434.2 may obtain the lifting of the suspension by a judge of the Court of Québec acting in chambers in civil matters after proving that he did not tolerate the contravention of section 433 or 434.
