Article 328.3
Le propriétaire du véhicule routier saisi peut être remis en possession du véhicule sur autorisation d’un juge de la Cour du Québec exerçant en son bureau en matière civile si, n’étant pas le conducteur du véhicule, il ne pouvait raisonnablement prévoir que ce dernier commettrait un excès de vitesse prévu au paragraphe 1° du premier alinéa de l’article 328.1 ou s’il n’avait pas consenti à ce que le conducteur soit en possession du véhicule saisi.
Le deuxième alinéa de l’article 209.11 et les articles 209.11.1 et 209.12 à 209.15 s’appliquent à la saisie avec les adaptations nécessaires.

Section 328.3
The owner of a seized road vehicle may recover the vehicle with the authorization of a judge of the Court of Québec acting in chambers in civil matters if, not being the driver of the vehicle, the owner could not reasonably foresee that the driver would commit a speeding offence under subparagraph 1 of the first paragraph of section 328.1, or if the owner did not consent to the driver being in possession of the seized vehicle.
The second paragraph of section 209.11 and sections 209.11.1 and 209.12 to 209.15 apply to the seizure, with the necessary modifications.
