Article 71
La Commission assure, par toutes mesures appropriées, la promotion et le respect des principes contenus dans la présente Charte.
Elle assume notamment les responsabilités suivantes:
1° faire enquête selon un mode non contradictoire, de sa propre initiative ou lorsqu’une plainte lui est adressée, sur toute situation, à l’exception de celles prévues à l’article 49.1, qui lui paraît constituer soit un cas de discrimination au sens des articles 10 à 19, y compris un cas visé à l’article 86, soit un cas de violation du droit à la protection contre l’exploitation des personnes âgées ou handicapées énoncé au premier alinéa de l’article 48;
2° favoriser un règlement entre la personne dont les droits auraient été violés ou celui qui la représente, et la personne à qui cette violation est imputée;
3° signaler au curateur public tout besoin de protection qu’elle estime être de la compétence de celui-ci, dès qu’elle en a connaissance dans l’exercice de ses fonctions;
4° élaborer et appliquer un programme d’information et d’éducation, destiné à faire comprendre et accepter l’objet et les dispositions de la présente Charte;
5° diriger et encourager les recherches et publications sur les libertés et droits fondamentaux;
6° relever les dispositions des lois du Québec qui seraient contraires à la Charte et faire au gouvernement les recommandations appropriées;
7° recevoir les suggestions, recommandations et demandes qui lui sont faites touchant les droits et libertés de la personne, les étudier, éventuellement en invitant toute personne ou groupement intéressé à lui présenter publiquement ses observations lorsqu’elle estime que l’intérêt public ou celui d’un groupement le requiert, pour faire au gouvernement les recommandations appropriées;
8° coopérer avec toute organisation vouée à la promotion des droits et libertés de la personne, au Québec ou à l’extérieur;
9° faire enquête sur une tentative ou un acte de représailles ainsi que sur tout autre fait ou omission qu’elle estime constituer une infraction à la présente Charte, et en faire rapport au procureur général et au directeur des poursuites criminelles et pénales.

Section 71
The commission shall promote and uphold, by every appropriate measure, the principles enunciated in this Charter.
The responsibilities of the commission include, without being limited to, the following:
1° to make a non-adversary investigation, on its own initiative or following receipt of a complaint, into any situation, except those referred to in section 49.1, which appears to the commission to be either a case of discrimination within the meaning of sections 10 to 19, including a case contemplated by section 86, or a violation of the right of aged or handicapped persons against exploitation enunciated in the first paragraph of section 48;
2° to foster a settlement between a person whose rights allegedly have been violated, or the person or organization representing him, and the person to whom the violation is attributed;
3° to report to the Public Curator any case it becomes aware of in the exercise of its functions where, in its opinion, protective supervision within the jurisdiction of the Public Curator is required;
4° to develop and conduct a program of public information and education designed to promote an understanding and acceptance of the object and provisions of this Charter;
5° to direct and encourage research and publications relating to fundamental rights and freedoms;
6° to point out any provision in the laws of Québec that may be contrary to this Charter and make the appropriate recommendations to the Government;
7° to receive and examine suggestions, recommendations and requests made to it concerning human rights and freedoms, possibly by inviting any interested person or body of persons to present his or its views before the commission where it believes that the interest of the public or of a body of persons so requires, with a view to making the appropriate recommendations to the Government;
8° to cooperate with any organization dedicated to the promotion of human rights and freedoms in or outside Québec;
9° to make an investigation into any act of reprisal or attempted reprisals and into any other act or omission which, in the opinion of the commission, constitutes an offence under this Charter, and report its findings to the Attorney General and to the Director of Criminal and Penal Prosecutions.
