Le mandataire ne peut, malgré toute stipulation contraire, renoncer à son mandat sans avoir au préalable pourvu à son remplacement si le mandat y pourvoit, ou sans avoir demandé l’ouverture d’une tutelle au majeur à l’égard du mandant.

Article 2174
Notwithstanding any stipulation to the contrary, the mandatary may not renounce his mandate unless he has first seen to his replacement if the mandate provides therefor, or has applied for the institution of tutorship to a person of full age for the mandator.

Le mandataire ne peut, malgré toute stipulation contraire, renoncer à son mandat sans avoir au préalable pourvu à son remplacement si le mandat y pourvoit, ou sans avoir demandé l'ouverture d'un régime de protection à l'égard du mandant.
Article 2174 (SQ 1991, c. 64)
The mandatary may not, notwithstanding any provision to the contrary, renounce his mandate unless he has previously provided for his replacement if the mandate provides therefor or has applied for the institution of protective supervision in respect of the mandator.

Commentaires

Cette disposition reprend l'article 1731.11 introduit au Code civil du Bas Canada en 1989. Elle a pour but d'éviter que le mandant devenu inapte soit laissé, sans protection. Avant de renoncer à son mandat, le mandataire doit veiller à ce que le mandant soit protégé autrement.
