Article 2730
Tout créancier en faveur de qui un tribunal ayant compétence au Québec a rendu un jugement portant condamnation à verser une somme d’argent, peut acquérir une hypothèque légale sur un bien, meuble ou immeuble, de son débiteur. Il l’acquiert par l’inscription d’un avis désignant le bien grevé par l’hypothèque et indiquant le montant de l’obligation, et, s’il s’agit de rente ou d’aliments, le montant des versements et, le cas échéant, l’indice d’indexation. L’avis doit être signifié au débiteur. L’avis est présenté avec une copie du jugement, sauf si cet avis vise à acquérir une hypothèque légale sur un bien immeuble à la suite d’un jugement rendu en matière familiale. Dans ce cas, il doit plutôt reproduire l’extrait pertinent du dispositif du jugement et, le cas échéant, l’extrait pertinent de l’entente ou du projet d’accord auquel le dispositif réfère. En outre, l’exactitude du contenu de cet avis doit être attestée par un notaire ou un avocat. Si l’avis est notarié, la seule signature du notaire tient lieu de cette attestation.

Article 2730
Every creditor in whose favour a judgment awarding a sum of money has been rendered by a court having jurisdiction in Québec may acquire a legal hypothec on the movable or immovable property of his debtor. He may acquire it by registering a notice describing the property charged with the hypothec and specifying the amount of the obligation, and, in the case of an annuity or support, the amount of the instalments and, where applicable, the basis of indexation. The notice must be served on the debtor. The notice must be filed with a copy of the judgment, unless the purpose of the notice is to acquire a legal hypothec on immovable property following a judgment rendered in a family matter. In that case, the notice must instead reproduce the pertinent extract from the operative part of the judgment and, as the case may be, the pertinent extract from the agreement or draft agreement to which the operative part refers. In addition, the accuracy of the content of the notice must be certified by a notary or an advocate. If the notice is notarial, the mere signature of the notary is sufficient certification.
