Article 89
L’époux ou le conjoint uni civilement ou le tuteur de l’absent peut, après un an d’absence, demander au tribunal de déclarer que les droits patrimoniaux des conjoints sont susceptibles de liquidation. Le tuteur doit obtenir l’autorisation du tribunal pour accepter le partage des acquêts du conjoint de l’absent ou y renoncer, ou autrement se prononcer sur les autres droits de l’absent.

Article 89
The married or civil union spouse of or the tutor to the absentee may, after one year of absence, apply to the court for a declaration that the patrimonial rights of the spouses may be liquidated. The tutor shall obtain the authorization of the court to accept or renounce the partition of the acquests of the spouse of the absentee or otherwise decide on the other rights of the absentee.
