Article 2177
Lorsque le mandant est inapte, toute personne intéressée, y compris le curateur public, peut, si le mandat n’est pas fidèlement exécuté ou pour un autre motif sérieux, demander au tribunal de révoquer le mandat, d’ordonner la reddition de compte du mandataire et d’ouvrir une tutelle au majeur à l’égard du mandant.

Article 2177
Where the mandator is incapable, any interested person, including the Public Curator, may, if the mandate is not being faithfully performed or for any other serious reason, apply to have the court revoke the mandate, order the rendering of an account by the mandatary and institute tutorship to a person of full age for the mandator.

Lorsque le mandant est inapte, toute personne intéressée, y compris le curateur public, peut, si le mandat n'est pas fidèlement exécuté ou pour un autre motif sérieux, demander au tribunal de révoquer le mandat, d'ordonner la reddition de compte du mandataire et d'ouvrir un régime de protection à l'égard du mandant.
Article 2177 (SQ 1991, c. 64)

Commentaires

Cette disposition reprend l'article 1756.1 introduit au Code civil du Bas Canada en 1989.


Elle permet au tribunal, en certaines circonstances, de révoquer un mandat lorsque le mandant est inapte. Le mandant n'étant pas apte à mettre fin lui-même au mandat, le présent article lui assure la protection nécessaire. Il s'agit d'un recours ouvert à tous ceux qui peuvent exercer de fait ce rôle de surveillance : personnel d'établissement de santé, les proches du mandant et le curateur public.
