Article 2167

Le mandat devant témoins est rédigé par le mandant ou par un tiers.

Le mandant, en présence de deux témoins qui n’ont pas d’intérêt à l’acte et qui sont en mesure de constater son aptitude à agir, déclare la nature de l’acte mais sans être tenu d’en divulguer le contenu. Il signe cet acte à la fin ou, s’il l’a déjà signé, il reconnaît sa signature; il peut aussi le faire signer par un tiers pour lui, en sa présence et suivant ses instructions. Les témoins signent aussitôt le mandat en présence du mandant.

Article 2167

A mandate made in the presence of witnesses is drawn up by the mandator or by a third person.

The mandator, in the presence of two witnesses who have no interest in the act and who are able to ascertain his capacity to act, declares the nature of the act but need not disclose its contents. The mandator signs the act at the end or, if he has already signed it, acknowledges his signature; he may also cause a third person to sign the writing for him in his presence and according to his instructions. The witnesses sign the mandate forthwith in the presence of the mandator.

Commentaires Cette disposition reprend l'article 1731.2 introduit au Code civil du Bas Canada en 1989. Les formalités du mandat devant témoins s'inspirent largement de celles prévues à l'article 727 du livre Des successions pour le testament devant témoins. Il y a en effet une similitude certaine entre le testament et ce nouveau type de mandat, puisque le mandant, s'il est vivant, n'est toutefois plus apte à consentir au moment où le mandat devient exécutoire.
