L’aliénation de l’entreprise ou la modification de sa structure juridique par fusion ou autrement, ne met pas fin au contrat de travail.
Ce contrat lie l’ayant cause de l’employeur.

Article 2097
A contract of employment is not terminated by alienation of the enterprise or any change in its legal structure by way of amalgamation or otherwise.
The contract is binding on the successor of the employer.

L'aliénation de l'entreprise ou la modification de sa structure juridique par fusion ou autrement, ne met pas fin au contrat de travail.

Ce contrat lie l'ayant cause de l'employeur.

Commentaires

Cet article vise à octroyer une protection au salarié quant au maintien de son emploi au cas d'aliénation ou de fusion de l'entreprise ou, encore, au cas de toute autre modification de sa structure juridique.


En effet, l'article 45 du Code du travail (L.R.Q., chapitre C-27) protège la structure syndicale, mais non pas chacun des salariés et les articles 96 et 97 de la Loi sur les normes du travail (L.R.Q., chapitre N-1.1) ne protègent que certains droits des employés. Cet article vient combler cette lacune.
