Article 163
Le défendeur assigné devant un tribunal autre que celui où la demande eût dû être portée, peut demander le renvoi devant le tribunal compétent relevant de l’autorité législative du Québec, ou, à défaut, le rejet de la demande.

Article 163
A defendant, summoned before a court other than that before which the suit should have been instituted, may ask that the suit be referred to the competent court within the legislative authority of Québec, or that the suit be dismissed if there is no such court.
